Summary

The case involves three consolidated appeals arising from the termination of Norwegian player Mathias Normann's employment contract with Russian club FC Rostov. Normann had suspended his contract under FIFA's Annexe 7 (temporary rules due to the Ukraine war) but later voluntarily returned to Russia and signed a loan with Dynamo Moscow. After the loan ended, he terminated his contract with Rostov, claiming just cause due to the deteriorating security situation (including the Wagner Group insurrection). Rostov disputed this and sought compensation. The FIFA DRC found the termination without just cause and ordered Normann and his new club Al Raed to pay EUR 2,923,507. All parties appealed to CAS. The CAS Panel upheld the finding of no just cause, rejecting arguments of force majeure and clausula rebus sic stantibus. It increased compensation to EUR 3,026,954.32, reflecting the value of the remaining contract and the loan fees Rostov lost. The Panel also held Al Raed jointly and severally liable for failing to check Normann's contractual status. Sporting sanctions were not imposed because Rostov, as an indirect FIFA member, lacked standing to request them. The Diarra judgment was deemed irrelevant. The award confirms that a player who voluntarily returns to a conflict zone cannot later invoke force majeure to terminate without consequences.
