Summary
Astaldi, an Italian construction company, contracted with Honduras to improve a highway. During execution, Astaldi faced delays, extra work, and cost increases due to site conditions, third-party actions, and government decisions. It submitted a claim for compensation, which the government partially rejected. After conciliation failed, Astaldi initiated ICSID arbitration under the contract's arbitration clause. The sole arbitrator, Eduardo Sancho González, rejected Honduras' jurisdictional challenge and proceeded to the merits. The tribunal analyzed eight claims: (1) costs for river diversion, overhauls, idle equipment, and acceleration; (2) sub-excavation; (3) additive for asphalt; (4) borrow pit; (5) fuel price increases; (6) asphalt repair; (7) wage adjustments; (8) final quantities. Applying the contract and Honduran law, the tribunal granted claims 1-6 and 8, finding that Astaldi had proven the extra work and costs, but denied claim 7 for wage adjustments due to lack of evidence. Honduras was ordered to pay the claimed amounts in both Lempiras and US Dollars, plus interest at 12% (Lempiras) and 4% (USD) from May 4, 2007, and costs. The award was rendered in Spanish and sent to parties on September 17, 2010.
